Aaron Olson, of Chisago City, Minn., filed for a harassment restraining order against his uncle, Randall LaBrie, ?in Oct. 2010, claiming "that family photos and accompanying text, posted by respondent to the social-networking web site Facebook, constituted harassment."
LaBrie had, as relatives are wont to do, posted family photos on his Facebook page from March to June 2010. Included in the trip down memory lane were photos of Olson in group portraits, such as in front of a Christmas tree.?
When Olson learned these photos had been posted, he emailed his uncle asking him to remove photos that included him or to Photoshop them (or some such editing method) to blur him out from recognition.?(No juicy details of why such photos were a problem?were given in the written decision.)?LaBrie's response in a word: no. LaBrie also advised his nephew to "stay off Facebook if he disliked the photos." At some point, however, LaBrie relented and removed photo tags and later, the photos.
In his defense, LaBrie said he had not intended for his nephew to see any of those pictures, that they were not Facebook friends and so should not have had access to those images. Apparently, however, LaBrie did not make the proper privacy adjustments to his photos, because Olson was able to print out pages that any member of the public could access.
Tensions between the family members escalated to comments "that could reasonably be interpreted as veiled threats agains" Olson's "life and safety." Olson accused his uncle of "a hostile tirade" online, posting those childhood memories with ?"obscene language." In filing for a two-year restraining order, Olson even went so far as to say his uncle's behavior and action had "restricted his movement "and caused reasonable alarm."?
But, when it came down it, the photos and comments just didn't meet the legal standard for harassment.
It also didn't help Olson's case that he went on a six page-tear of "multiple accusations of bias against the district court and opposing counsel"?without "one citation to a statute or caselaw."?

The district court also found that the family Christmas pictures were innocuous photos that "could not possibly serve as a basis for harassment," a finding that appellant does not contest. To constitute harassment, words must have a substantial adverse effect on the safety, security, or privacy of another. Minn. Stat. ? 609.748, subd. 1(a)(1). Comments that are mean and disrespectful, coupled with innocuous family photos, do not affect a person's safety, security, or privacy?and certainly not substantially so. The district court did not err by determining that the evidence submitted by appellant did not satisfy the statutory definition of harassment. Therefore, the district court did not abuse its discretion by dismissing appellant's petition for an HRO.

ScienceDaily (Feb. 21, 2012) ? Nearly 13.7 billion years ago, the universe was made of only hydrogen, helium and traces of lithium -- byproducts of the Big Bang. Some 300 million years later, the very first stars emerged, creating additional chemical elements throughout the universe. Since then, giant stellar explosions, or supernovas, have given rise to carbon, oxygen, iron and the rest of the 94 naturally occurring elements of the periodic table.
Today, stars and planetary bodies bear traces of these elements, having formed from the gas enriched by these supernovas over time. For the past 50 years, scientists have been analyzing stars of various ages, looking to chart the evolution of chemical elements in the universe and to identify the astrophysical phenomena that created them.
Now a team of researchers from institutions including MIT has detected the element tellurium for the first time in three ancient stars. The researchers found traces of this brittle, semiconducting element -- which is very rare on Earth -- in stars that are nearly 12 billion years old. The finding supports the theory that tellurium, along with even heavier elements in the periodic table, likely originated from a very rare type of supernova during a rapid process of nuclear fusion. The researchers published their findings online in Astrophysical Journal Letters.
"We want to understand the evolution of tellurium -- and by extension any other element -- from the Big Bang to today," says Anna Frebel, an assistant professor of astrophysics at MIT and a co-author on the paper. "Here on Earth, everything's made from carbon and various other elements, and we want to understand how tellurium on Earth came about."
'In the halo of the Milky Way,' a rare element found
The team analyzed the chemical composition of three bright stars located a few thousand light-years away, "in the halo of the Milky Way," Frebel says. The researchers looked at data obtained from the Hubble Space Telescope's spectrograph, an instrument that splits light from a star into a spectrum of wavelengths. If an element is present in a star, the atoms of that element absorb starlight at specific wavelengths; scientists can observe this absorption as dips in the spectrograph's data.
Frebel and her colleagues detected dips in the ultraviolet region of the spectrum -- at a wavelength that matched tellurium's natural light absorption -- providing evidence that this element does indeed exist in space, and was likely created more than 12 billion years ago, at the time when all three stars formed.
The researchers also compared the abundance of tellurium to that of other heavy elements such as barium and strontium, finding that the ratio of elements was the same in all three stars. Frebel says the matching ratios support a theory of chemical-element synthesis: namely, that a rare type of supernova may have created the heavier elements in the bottom half of the periodic table, including tellurium.
No ordinary supernova
According to theoretical predictions, elements heavier than iron may have formed as part of the collapsing core of a supernova, when atomic nuclei collided with huge amounts of neutrons in a nuclear fusion process. For 50 years, astronomers and nuclear physicists have modeled this rapid process, named the r-process, in order to unravel the cosmic history of the elements.
Frebel's team found that the ratios of heavy elements observed in the three stars matched the ratios predicted by these theoretical models. The findings, she says, confirm the theory that heavier elements likely formed from a rare, extremely rapid supernova.
"You can make iron and nickel in any ordinary supernova, anywhere in the universe," Frebel says. "But these heavy elements seem to only be made in specialized supernovas. Adding more elements to the observed elemental patterns will help us understand the astrophysical and environmental conditions needed for this process to operate."
Jennifer Johnson, an associate professor of astronomy at Ohio State University, says tellurium has been a "tough" element to detect, since it absorbs light in the ultraviolet spectrum, which is impossible for ground-based telescopes to spot. The team's findings, she says, are a first step in identifying some of the most elusive elements in the universe.
"If you look at the periodic table, tellurium is right in the middle of these elements that are hard for us to measure," Johnson says. "If we need to understand how [the r-process] works in the universe, we really have to measure this part of the periodic table. It's really cool that they got this element in this sea of unknown-ness."
Frebel is continuing the search for heavy elements in space. For example, selenium -- which is similar to tellurium -- has yet to be detected in the universe. Tin, Frebel says, is also a difficult element to spot, as are many elements along the same row as tellurium in the periodic table.
"There are still quite a few holes," Frebel says. "Every now and then, we can add an element, and it adds another data point that makes our work easier."

The Labor Department said weekly applications for unemployment benefits dropped for the fourth time in five weeks, reaching their lowest point since March 2008.
The agency also said that a broad measure of wholesale inflation came in lower than expected. But excluding food and energy, the adjusted figure was above expectations.
Low inflation makes it easier for the Federal Reserve to keep the short-term interest rate it controls low. If there were signs that inflation was increasing rapidly, the Fed would likely raise rates.
Dow Jones industrial average futures reversed an earlier decline to gain a point to 12,764, while Standard & Poor's 500 futures were down 2.4 points to 1,339.80. Nasdaq Composite index futures slipped 0.75 points to 2,556.75.
European markets did not fare as well. The major indexes slid as worries escalated over the potential for a new bailout for Greece. Without a deal, Greece could default within a month.
In London, the FTSE 100 index was down 0.13 percent at 5,892.16. Germany's DAX fell 0.88 percent to 6,698.36. The CAC-40 in France was 0.59 percent lower at 3,370.44.
U.S. stocks to watch on Thursday include General Motors Co., which earlier reported its largest profit ever for 2011, just two years after it nearly collapsed. The automaker earned $7.6 billion for the year. Meanwhile, Duke Energy reported a 33 percent drop in its fourth quarter profit, reflecting mild temperatures and escalated costs for repairs due to storm damage.
Late Wednesday, hotel operator Marriott International Inc. said its fourth-quarter profit fell 18 percent due to costs associated with spinning off its timeshare business. NEWARK, N.J. (AP) ? Gov. Chris Christie has strongly defended his decision to have flags flown at half-staff Saturday for Whitney Houston despite receiving emails and other messages disparaging the singer and criticizing him.
The Republican governor said Wednesday that he rejects complaints that Houston "forfeited the good things that she did" because of her struggles with substance abuse.
"What I would say to everybody is there but for the grace of God go I," he said.
Christie ordered flags flown at half-staff at state government buildings Saturday, the day funeral services are held for Houston at the Newark church she sang at as a child.
Twitter was abuzz Wednesday with reaction to the decision by Christie, whose home is in Mendham, a wealthy town where Houston also had lived.
In online postings, there were two main arguments against the honor for the Grammy Award winner who died over the weekend in California at age 48: One was that it should be reserved for members of the military, first responders and elected officials. The other was that it's wrong to honor a drug addict.
Heather Clause, a Richmond, Va.-based blogger who writes about teen moms and was tweeting critical comments, said in a telephone interview that she was appalled by the planned flag-lowering.
"It's just such a bad example for people," said 23-year-old Clause. She said the decision was like saying if someone sings well, drug use doesn't matter and "you can still be an idol."
In upstate New York, Rebecca Eppelmann, a newspaper copy editor, also tweeted her disgust at the Houston honor, then discussed her views.
"It should be for major events," she said. "It's horrible that she passed away. It's not something that should warrant this."
Christie said he was not saying that Houston, who was born in Newark and was raised in nearby East Orange, is a role model. Instead, he said, Houston deserves the honor because of her huge cultural impact and as "a daughter of New Jersey."
"I am disturbed by people who believe that because her ultimate demise ? and we don't know what is the cause of her death yet ? but because of her history of substance abuse that somehow she's forfeited the good things that she did in her life," said the governor during a briefing in northern New Jersey. "I just reject that on a human level."
The cause of Houston's death at a Beverly Hills hotel has not been determined, and the results of toxicology tests are pending. Investigators found several bottles of prescription medication in the hotel room where she died Saturday, but authorities said they weren't an unusually large number.
The governor noted he has ordered flags flown at half-staff for all 31 fallen New Jersey soldiers and every fallen police officer during his time in office.
He also ordered flags lowered last year for Clarence Clemons, the saxophonist for Bruce Springsteen's E Street Band.
In Newark, residents were irritated to hear of criticism of the governor's decision to honor Houston, who acknowledged her drug abuse in interviews.
Resident Anna Simpson said she admires Christie for honoring Houston because "if it were Bruce Springsteen or Jon Bon Jovi, nobody would bat an eye."
Simpson was at New Hope Baptist Church Wednesday, where Houston's funeral will be held, to pay her respects on her way home from her airport job.
"She never forgot where she came from," Simpson said. "She was real. We would see her and be like, 'She's one of ours,' and she always made us proud, no matter what happened."

Prosecutors said Mullah Krekar, a 55-year-old Islamist who came to Norway as a refugee in 1991, faces several years in prison if found guilty by Oslo District Court.
Since his arrival, Krekar has made frequent trips to Iraq where in 2001 he founded the Kurdish Ansar al-Islam, a group suspected of organizing suicide bombings against coalition forces in Iraq, and listed as a terrorist organization by the United States and other nations.
In 2005, a Norwegian court declared Krekar a national security threat and ordered him deported, but later postponed the move because of concerns he could face execution or torture in Iraq.
In June 2010, Krekar said at a news conference organized by the foreign press club in Oslo that if he were deported to Iraq and killed, Norwegian officials would "pay with their lives," according to a transcript included in the indictment presented in court.
"If I die it will be the beginning of killings," he said, according to the transcript.
Prosecutor Marit Bakkevig said Krekar had violated Norwegian terror laws by "threatening to commit murder for the purpose of creating fear in the society," which carries a maximum 12-year sentence. "The statements appear as persistent threats," she told the court.
Krekar is also charged with trying to force a reversal of the deportation order by threatening officials, or obstructing the government from performing its duties, with a maximum prison sentence of 15 years.
In addition, he has allegedly threatened several people on various websites, including three Kurds living in Norway, the prosecution said.
In 2009, on NBC's news program "The Wanted," Krekar said that America had deserved the Sept. 11, 2001, terror attacks, and condoned suicide bombings against Americans in Iraq. Because the interviews were conducted in Norway, he is being tried in the Scandinavian country for these statements.
By condoning suicide bombings, he was charged with "publicly encouraging illegal actions," which has a maximum eight-year sentence.
The prosecution told the court that Norwegian security police initiated the investigation of Krekar after the NBC interviews.
During the proceedings, court officials were shown several TV clips of Krekar, including the NBC program, causing the bearded cleric to occasionally smile and at times shake his head. The clips were not visible to the public.
Krekar has said that he stands by the statements he made to the journalists. But his lawyer, Brynjar Meling, said he is discussing with Bakkevig about modifying how Krekar's alleged threats are described in the transcripts. "Some of the translations are absolutely wrong," Meling told The Associated Press.
Meling insists Krekar has not broken the law.
"It should not be looked upon as threats," Meling said.
Meling said this is "a test case" for drawing the line between Norwegian terror laws and freedom of speech.
The gray-robed Krekar appeared calm, making notes during the first day of the trial, expected to last three weeks.
Krekar, who told the court he lives at a secret address and has no job, has denied links to al-Qaida and says he no longer leads Ansar al-Islam, an al-Qaida-linked group, which has vowed to set up a conservative Islamic state in northern Iraq.
